VI. FLOYD COUNTY REZONINGS & SPECIAL USE PERMITS
The Floyd County Board of Commissioners will con-duct a First Reading on Tuesday, June 24, 2008 at 6:00 PM, on the sec-ond floor of the County Administration Building, 12 East Fourth Ave-nue, in Rome, Georgia; and a Public Hearing on Tuesday, July 8, 2008 at 2:00 PM, on the second floor of the County Administration Building, 12 East Fourth Avenue, in Rome, Georgia to act on the recommenda-tions made by the Planning Commission. The meetings are open to the public. All documents are available for public review.
A. The Planning Commission split, 4 to 4, on a request for rezoning from H-TR High-density Traditional Residen-tial to S-R Suburban Residential, with a Special Use Permit for manufactured home on subdivision lot at201 Alexander Ave. in Lindale.
The recommendation will go to the County Commission as a denial, with the tie recorded.
Mark Wood has a temporary medical hardship permit to allow a manufactured home for his elderly mother, but said he needs permanent zoning to finance a replacement for the ramshackle 1984 structure that was on the lot.
Four planning commission members were concerned that al-lowing Woods manufactured home would open the door for others in the Lindale neighborhood of site-built homes: Graham Dixon; Bill Irmscher; Charles Jackson; and John Maddox.
Members Ronnie Kilgo; Von Lambert; Jarrell Cagle and Shirley Denmon supported the request.
B. WITHDRAWN: No action taken on FILE #66-2008SUP, Special Use Permit for manufactured home on subdivision lot at 108 Pine Park Ave.
C. Members recommended denial in a 5-4 vote on FILE #68-2008SUP, Special Use Permit for manufactured home on subdivision lot at 1282B Radio Springs Road.
Owner Carlene Weddington said she wanted to replace one of two rental units on the property but neighbor Barry Casey ob-jected saying sewage from the site runs into a shared creek and he was told in 1988 there would be no more manufactured homes allowed in the area.
Planning Director Sue Hiller said site-built homes predomi-nate in the area and the few manufactured homes appear to be older.
Favoring the request were Cagle; Jackson; Kilgo and Lam-bert. Against were Denmon; Dixon; Irmscher; Maddox; and Rhonda Wallace, who arrived at the start of the hearing.
CITY OF ROME REZONINGS & SPECIAL USE PER-MITS
The Rome City Commission will conduct a First Read-ing on Monday, June 16, 2008 at 6:30 PM, and a Public Hearing on Mon-day, July 7, 2008 at 6:30 PM on the top floor, the Rome City Hall, 601 Broad Street, in Rome, Georgia to act on the recommendations made by the Planning Commission. The meetings are open to the public. All documents are available for public review.
A. Unanimously recommended approval of FILE #61-2008Z, Rezoning from H-I Heavy Industrial to O-I Of-fice Institutional for instructional classrooms, storage, and other uses at 218 John Davenport Drive.
Dick Taylor of Shorter College said the school wants to re-model the inside of the building for band practice. It is currently used as a warehouse and maintenance base. Students would be shuttled to the site so parking would not be an issue, he said.
B. Unanimously recommended denial of FILE #62-2008Z, Rezoning from S-R Suburban Residential to C-C Community Commercial to market property at 3330 Callier Springs Road.
This marks the second time Day Spring Assembly of God has lost its bid for commercial zoning of its site on the corner of U.S. 411 and Callier Springs Road across from the Wal-Mart Supercenter.
Pastor Robert Anderson said the new plan addresses concerns raised last year by residents in the Chulio Hills subdivision to the south by using only the church parcels that front on U.S. 411 and increasing the buffers.

However, resident Elaina Beeman said the planned access from Callier Springs would compound traffic and safety prob-lems longtime residents are already experiencing.
Those are substandard roads, Beeman said. Yes, there has been development. But our streets havent been touched.
Resident Curtis Mitchell also asked the planning commission to consider the safety of residents who live on the narrow and winding road.
Bill Palaski, the real estate agent representing the church, said Rome officials have approved a right-in-right-out access from U.S. 411 however, Hiller noted that permission must come from the Georgia Department of Transportation.
Planning Commission members also expressed concern be-cause the rezoning is speculative and there is no site plan to gauge the impact on the neighborhood.
That is the challenge of 411, Hiller said. The city and county commissions have said it seems reasonable to have commercial growth along that corridor, but theyve also indi-cated the need to provide protections to existing residents who live further back.
C. Unanimously recommended approval of FILE #64-2008SUP, Special Use Permit to construct duplex dwelling in the LTR Low Density Traditional Residen-tial District at 616 Excelsior St.
Johnny Mayes said he plans to put three duplexes on the va-cant tract.
D. Unanimously approved FILE #65-2008Z, Rezoning from L-I Light Industrial to O-I Office Institutional with a Special Use Permit for Group Day Care Home for 7 to 18 persons at 201 East 19th St.
Hiller emphasized that the planned facility is a day care with no overnight stays.
Kimberly Bush said she wants the property to expand her business offering care for children with special needs. There will be no signs on the house, she said, so it will look just like a residence.
E. Postponed a decision on FILE #67-2008Z, requesting H-C Heavy Commercial zoning without the limi-tations on use placed during a 2003 rezoning from C-C Community Commercial on property located at 844 Turner McCall Blvd.
Jimmy Black of Triple C Development said Gerber Auto Col-lision and Glass is asking officials to remove a pre-existing zoning condition that prevents it from painting vehicles on the site.
Black said the national chain would use a paint booth with a downdraft system to capture all emissions, but planning com-mission members tabled a vote pending further details.
City Commissioner Duane Reid, who represents Rome on the planning board, noted the conditions were originally placed on the property to protect the nearby Between The Rivers historic district.
The Board of Adjustments recently approved a variance that decreases the size of the required buffers around the property which is another concern, Reid said.
F. WITHDRAWN: No action taken on FILE #69-2008Z, Request rezoning from D-R Duplex Residential to O-I Office Institutional to construct office at 201 Redmond Road.

VIII. TEXT AMENDMENTS
Final decisions will be made by the Rome and Floyd County commissions. Rome will hold a public hearing at its July 7 meeting. Floyd County will hold a public hearing at its July 8 meeting.
A. Recommended revision of Article 6.15.11 regarding NPDES compliance
Adds language stating any land disturbances must follow Best Management Practices for maintaining water quality as set by the National Pollution Discharge Elimination System.
B. Recommended revision of Article 6.17.3 regarding land-scaping plan
Requires a landscape plan to be included with the permit ap-plication for apartment, commercial and industrial construc-tion.
C. Tabled a decision on a proposed revision to Article 6.6.8 that would require outside lighting to be downcast and directed.
Hiller said the requirement is often a condition of rezoning when property abuts residential areas. The proposal emerged from discussions on overlay development zones along U.S. 411 and near Richard B. Russell Regional Airport, she said.
Planning commission members, however, had various objec-tions ranging from the financial hardship on small businesses and vague wording to the impact on Christmas lights, church spires and special events advertising.
D. Recommended revision of Article 6.17.2 a. regarding landscaping islands in parking lots.
The ordinance calls for one deciduous tree to be planted for every 20 parking spaces in a development. The revision clarifies that each tree must be planted near the spaces it is meant to shade.
E. Recommended revision of Article 6.17.2.c. regarding landscaping islands in parking lots
Allows for cuts in the six-inch curbs surrounding landscape islands so the ground can absorb stormwater runoff.
F. Recommended revision of Article 6.6.1 and 6.4.2 con-cerning dedication of additional right-of-way along ex-isting streets
New developments must dedicate a minimum of 50 feet of right-of-way for road improvements. Under the revision, if the city or county has a project already programmed for the road, the developer must dedicate the amount of right-of-way needed for the project.
G. Recommended revision of Article 6.9.3 regarding inter-parcel access easements
New developments must plan for interconnection between parcels so customers dont have to get back on a main street to move between them.
The revision allows the public works director instead of the building official to grant a variance if he or she decides the access is unnecessary. The change ensures an engineer is the one making the decision, Hiller said.

X. OLD BUSINESS Hiller will update the Rome City Commission on work connected to a revision of the sign or-dinance. The presentation, open to the public, will be at the boards 5 p.m. caucus on Monday at City Hall.
