Entice Adult Superstores plans to appeal the dismissal of its lawsuit against Floyd County are continuing on schedule.
A Thursday filing by the Clerk of U.S. District Court certifies all documents are in order for the Shannon stores appeal of a ruling dismissing its challenge to the countys ordinance regulating sexually oriented businesses.
Attorney Alan Begner, who represents Entice owner Charles Craton of Rome, said today his brief is due to the court the last week of May.
However, court mediation is scheduled for June 3 to discuss a settlement, so the deadline will likely be postponed.
The mediation administrator usually postpones the brief schedule so mediation may be meaningful, Begner said.
Federal judge Harold Murphy of Rome dismissed Entices suit against the county in March but the pending appeal keeps the case open.
The Thursday certification by the clerk states the record, including transcripts and exhibits, consists of 15 volumes of pleadings.
