Charges against local comic book store owner Gordon Lee have been dismissed, according to Floyd County District Attorney Leigh Patterson.
Im still catching my breath from it, Lee said Sunday. (The announcement) hit me so quick that everything is still a blur.
Patterson said the case was dismissed after her office met with Lees counsel and decided a measure other than prosecution could be taken in resolving the case.
He did a written apology to the victims in the case, said Patterson.
The former charges stem from a Halloween 2004 giveaway when an employee of Legends Comics in Rome gave a copy of Alternative Comics No. 2 to two 6- and 9-year-old brothers.
In the comic book, a series of drawings depict a naked Pablo Picasso. The images were used to depict his first meeting with fellow Cubist Georges Braque.
The case was declared a mistrial in November 2007, after a prosecutor alluded to Gordon Lee appearing in court before on similar charges.
Lee was originally charged with six counts, including two felonies in 2004, but during the course of the case all but two misdemeanor charges had been dismissed until this past week.
