Former student settles with Berry in rape case

A former Berry College student who claims she was repeatedly raped by another student has reached an undisclosed settlement with the college regarding her lawsuit against it and her alleged attacker.

Legal action began when the plaintiff, identifying herself only as Jane Doe, filed a lawsuit in 2004 that accuses Marcus Sandalowsky of stalking, sexually harassing, assaulting and raping her between the fall of 2001 and the winter of 2004. He also allegedly harassed another women and harassed and attempted to rape another, according to the suit.

Doe 1 had accused Berry of failing to take action after learning of the assaults. In a letter dated Sept. 4 and released last week the settlement was announced but not detailed.

This settlement will end this part of the litigation. However, Doe’s claim against Sandelowsky will continue as will his counter claim.

Sandelowsky — who does not face any criminal charges in relation to the alleged assaults — has accused the women of hiding behind rape shield laws while dragging his name through the mud.
